The Discipline Notice publishes findings and admissions of unprofessional conduct by AIBC Registrants.
As the regulator of the architectural profession in British Columbia, the AIBC establishes, monitors, and enforces standards of ethical and professional conduct for all AIBC Registrants: Architects, Architectural Firms, Intern Architects, Architectural Technologists, Retired Architects, and Temporary Licensees (Architects). All Discipline Violations are Published in accordance with the requirements under AIBC Bylaw heading 8.0 Public Disclosure.
Note: Effective February 10, 2023, the Architects Act (Act) was repealed and the AIBC continued under the authority of the Professional Governance Act (PGA). As part of the transition, the Architects Regulation section 7(2), deems the discipline committee established under the Act to be the discipline committee for the AIBC on and after the designation for the purpose of continuing the hearing. The noted breaches reference the repealed Architects Act and former Bylaws that were in force at the time of the infractions. The corresponding AIBC Bylaws and Professional Standards under the PGA are also identified.
AIBC Discipline Decision
- Mr. Gee contravened sections 27(2) and 63(2) of the Architects Act and AIBC Bylaw 33.3, (current AIBC Bylaw 4.36 and Professional Standard 4.1(c) in the AIBC Bylaws Schedule A: Code of Ethics and Professional Conduct) when, between April 2015 and July 2017, he offered to provide and did provide architectural services for the project through GLA when neither he nor GLA held a certificate of practice. Mr. Gee did not contravene section 28 of the Architects Act (corporation carry on business without a certificate of practice);
- Mr. Gee did not contravene section 65(1) of the Architects Act or AIBC Bylaws 33.3 (partnership with a non-architect);
- Mr. Gee contravened AIBC Bylaw 34.10 and council rulings (e) and (f), and AIBC Bylaw 34.1 and council ruling (b), (current Professional Standards 5.1 and 5.2 and 6.3 in the AIBC Bylaws Schedule A: Code of Ethics and Professional Conduct) when a non-registrant signed GLA’s April 25, 2015, Service Fee and Proposal with the client on behalf of GLA and that the Service Fee and Proposal did not include the required statements as to professional liability insurance and compliance with AIBC Bylaws;
- Mr. Gee contravened AIBC Bylaws 28.2 and 34.5 (current Professional Standards 5.3 and 1.2 in the AIBC Bylaws Schedule A: Code of Ethics and Professional Conduct), when he did not notify the financial institution of the change orders for the project and in his preparation of the certificates of payment that he provided to the financial institution or knew would be provided to the financial institution, including a certificate of payment that he sent to the financial institution on the day GLA was retained to work on the project;
- Mr. Gee contravened AIBC Bylaws 30.1 and 34.5 (current Professional Standards 3.1 and 1.2 in the AIBC Bylaws Schedule A: Code of Ethics and Professional Conduct) when he did not advise the financial institution of the change orders for the project;
- Mr. Gee contravened AIBC Bylaw 30.1 (current Professional Standard 3.1 in the AIBC Bylaws Schedule A: Code of Ethics and Professional Conduct) when he failed to complete the field reviews for the project with reasonable care and competence; and
- Mr. Gee contravened AIBC Bylaw 34.1 and council ruling (b) (current Professional Standard 6.3 in the AIBC Bylaws Schedule A: Code of Ethics and Professional Conduct) when he failed to provide adequate supervision, direction, and control of the architectural services provided on the project, in relation to the Service Fee and Proposal that GLA entered into with the clients on April 25, 2015.
