RAIC – AI and Waiver of Privilege
Artificial intelligence tools are transforming how construction professionals manage projects, draft contracts, and communicate with counsel. But what happens when confidential or privileged information is uploaded to an AI platform? This webinar examines the emerging legal risks surrounding AI use and the inadvertent waiver of solicitor-client privilege and litigation privilege in construction projects. Drawing on recent case law the presenters will explore how courts are applying traditional privilege principles to AI usage and AI-generated materials. Participants will learn about the practical governance controls that architects, engineers, and construction professionals can implement to protect privileged information, including data classification protocols, routing legal-strategy work through counsel, maintaining audit trails, and selecting enterprise-grade AI platforms with appropriate confidentiality safeguards.
