AIBC Illegal Practice Notice | October 28, 2020

October 28, 2020

The Illegal Practice Notice highlights summaries of illegal practice resolutions involving individuals or businesses not registered with the AIBC.

Through the authority granted under the Architects Act, the AIBC investigates and takes appropriate steps when non-architects illegally offer or provide architectural services or represent themselves as architects or other AIBC registrants.

AIBC Illegal Practice Resolutions

Over the past months, the AIBC has secured a number of resolutions related to the illegal practice of architecture and misrepresentation (e.g., misuse of “architect” and “architecture”). The AIBC has also obtained Undertaking and Covenant Agreements from:

Mr. Zhi Chao Li (aka Lukas Li) of Prosperous Square Development Ltd.
Mr. Li, who is not an architect, swore an affidavit that was filed with BC Small Claims Court, stating that his company provides architectural services. Through the Undertaking and Covenant Agreement, Mr. Li has acknowledged his breach of the Architects Act and committed to compliance in the future.

Mr. Reto Steiner of InDevelopments Corp.
Mr. Steiner, who is not an architect, prepared and submitted drawings in support of a development permit application for a daycare which, based on its size, required the services of an architect under the Architects Act. Through the Undertaking and Covenant Agreement, Mr. Steiner has acknowledged his breach of the Architects Act and committed to compliance in the future.

Mr. Brent Ziola of Neoteric 3D Inc. / Ziola Design.
Mr. Ziola, who is not an architect, prepared and submitted drawings in support of two separate development permit applications for a restaurant and a townhouse complex which, based on their size, required the services of an architect under the Architects Act. Through the Undertaking and Covenant Agreement, Mr. Ziola has acknowledged his breach of the Architects Act and committed to compliance in the future.

Mr. Kamran Kambakhshfard of Bourcet Engineering.
Mr. Kambakhshfard, who is not an architect, prepared and submitted drawings in support of a development permit application for a commercial building which, based on its size, required the services of an architect under the Architects Act. Through the Undertaking and Covenant Agreement, Mr. Kambakhshfard has acknowledged his breach of the Architects Act and committed to compliance in the future.
