Amendments to the Project Takeover Professional Standards Consultation Session Recap

The consultation session for the proposed amendments to the Project Takeover Professional Standards took place on Tuesday, December 5. It was a hybrid event, with more than 160 Registrants in attendance. Presenters included Brian Sim Architect AIBC, member of the Professional Standards Advisory Group; Thomas Lutes AIBC General Counsel and Deputy CEO; and Maura Gatensby Architect AIBC, CP, AIBC Lead Practice Advisor and Regulatory Liaison.

The presentation began with background information on the regulatory foundation for the AIBC and Professional Standards generally, and continued with an overview of each proposed amendment to the Project Takeover Professional Standards, including how Architects and other Registrants would comply.

There was also discussion around copyright, particularly in the scenario where a project has a new owner. Several legal cases were referenced, including Ankenman Associates Architects Inc. v. 0981478 B.C. Ltd. from 2017. This case and others are helpful in understanding Registrants’ rights in relation to payment under contract, architects’ liens, and copyright assertion.

Further discussion took place after the presentation, with questions being asked by attendees, both in-person and online. The event concluded after all questions were answered, and participants were encouraged to submit any further feedback or inquiries to bylawfeedback@aibc.ca.

Please note that viewing the recording of the Consultation Session is only eligible for Non-core Learning Units.

Registrants are also reminded and encouraged to review and provide feedback on the proposed amendments to the Project Takeover Professional Standards by either emailing bylawfeedback@aibc.ca or by responding to an online feedback survey. All feedback received will be considered by the Professional Standards Advisory Group, the AIBC Board, and AIBC staff.
